TERMS & CONDITIONS
These Terms and Conditions will be part of the contract between the customer and Pink Gift Store. All products sold are sold under the brand name Pink Gift Store. Pink Gift Store is registered in England and Wales, company no. 11562459.
Contract Of Sale
When buying goods or services on the internet, you are entering into a legally binding contract. We must receive payment in whole for the price of the goods that you order before your order can be fully accepted.
All orders that are placed here at Pink Gift Store will be subject to acceptance in accordance with these Terms and Conditions. Anytime you purchase a product from Pink Gift Store, we will always ensure that a confirmation email / receipt is sent out to you, which will include all the details of the order you have placed with us.
When your order has been dispatched we will then show a final acceptance of your order and send a Dispatch Confirmation email. If you notice then there and any products not showing in this confirmation invoice, the items not showing will not have been purchased or had any payment taken for. Until a complete payment has been made with us the ownership of the products will remain with Pink Gift Store.
Prices and Availability
All prices are shown in Pound Sterling (£) and are inclusive of VAT. The prices shown on the products do not include the charges for delivery. All delivery charges will be shown when reaching the checkout when placing your final order. Prices are subject to change and any offers that may be given can be temporary and are able to be withdrawn at any given time.
All of the products shown on our website will show their availability, whether they are in or out of stock. There may be times where an order is taken offline and therefore we are not always able to guarantee that items will be available, especially when the particular item is low in stock. You can still order an out of stock product if we have more on order but we will not take any charges until the item has been dispatched out to you.
When displaying our products online, we try our very best to make sure that everything is displayed correctly and that the prices shown are accurate. Sometimes it may be possible for small mistakes to occur. In the case of any mistakes made on items placed into an order, we will be sure to contact you as soon as possible. The option will be put forward to you where you will then need to confirm if you would like to continue to place the order with the correct pricing or if you would prefer to cancel. We will do our best to get hold of you but unfortunately if this proves to not be possible we will consider the incorrectly priced item as cancelled and an email to confirm this will be sent.
Mainland UK Delivery
Delivery is priced at £3.99 for standard delivery orders, £6.00 for next day delivery orders and £15 for Saturday orders. Orders will be subject to usual VAT charges (for customers in the UK who are not VAT registered).
When you place an order with us, the order will only be dispatched out to you once a payment is received here at Pink Gift Store. We hold the right to make part deliveries but we do make our best efforts to make sure the orders are complete.
We hope you will be happy with your purchase but we are happy to exchange or refund within 14 days of your receipt. If you wish to cancel your order, please contact us in writing for it to be considered at email@example.com.
Under the Consumer Contracts Regulations, if you buy anything by phone or online, consumer rights entitle you to a full refund if you request for one in writing within 30 calendar days of receipt. We do apologies but any personalized items cannot be refunded or exchanged unless faulty. It is important that items are returned in perfect condition, with tags still attached. Please take care of them and pack appropriately. For more information on our returns we have written a full shipping and returns policy with everything you need to know. Please take a look.
All of our shipping and return options and charges are specified on our website. Shipping outside of the UK may incur additional delivery costs. Heavy items may be subject to a delivery surcharge which will be shown on the applicable product page.
If any item is ordered but is out of stock at that point, we will deliver the products in two stages. The first order that you will receive will have all the fully stocked items in it and will be dispatched immediately and the second order will follow with the products that were not in stock. You will have the option to wait for the order or cancel them. In the lead up to Christmas this will be the only exception of products being dispatched as and when they are stocked and therefore may arrive individually.
When you make your order you will have the option to put a delivery address, we will deliver to the address requested at the time of your order. It is your own responsibility to ensure that any details you provide to us are correct and that somebody will be there to accept the delivery.
Any orders of Next Day Delivery and deliveries that are large or heavy may require a signature. If your order happens to get returned to us by the carrier or postal service and the delivery could not be completed for any given reason, then we do advise you that you will be responsible for any future delivery costs.
We cannot be held responsible if there are any delays that may occur due to circumstances beyond our control. These issues may include ; quality control issues, strikes, without limitation, breakdown of I.T systems, industrial disputes, fire, explosion, flood or accidents.
Once your items arrive you then take ownership of any goods once they have been delivered after which point they are held at your own risk. We will not be held liable for the loss or destruction of any of the items.
Clearance and Promotions
Whenever we show products with a reduced price on Pink Gift Store, the following policy will always apply. The 'was' price is the highest price the item has ever been offered for sale at on our website in the last 12 months and will have applied for a continuous period of 28 days or more. Clearance products and promotions are subject to availability and may be changed or withdrawn by us without notice. We reserve the right to cancel a promotion or reject redemption of a promotional code when stock runs out or when the total value of the promotional codes already exceeds a certain financial value.
Us or third parties occasionally publish promotional discount codes which may be applied to specified purchases that are made through this website. This only applies to purchases made on full priced products and cannot be used in conjunction with any other offers or discounts.
Cancellations By You
Under the Consumer Contracts Regulations, if you buy online or by phone, consumer rights entitle you to a full refund if you request one in writing within 28 calendar days of receipt. We are sorry but personalized products, food and self-assembly furniture (once partly or wholly assembled) cannot be refunded or exchanged unless faulty.
When you receive any item from Pink Gift Store you will also receive a return form inside the parcel. If you decide to cancel your contract, please complete the returns form in the parcel and make sure to re-package the goods appropriately to ensure that when they return they are in perfect condition. We always recommend to our customers that when returning anything you request a Proof of Postage certificate (free) from the Post Office.
If you would like to cancel an order before receiving it, we are only able to do so if the product has not been dispatched. If the item has already been dispatched you will need to follow the returns policy once receiving the item. Any sums that are debited from your credit card will be credited to your account as soon as possible. In the event of a return, you will only be credited back once the goods have been returned by you and we have received the item in great condition. We reserve the right to not refund you or deduct the direct costs of recovering the goods from the amount to be credited to you. We will only refund delivery costs if you received an item that is damaged, faulty or incorrect.
Cancellation By Us
We reserve the right to cancel the contract between you and us if we have insufficient stock to deliver the goods you have ordered, we do not deliver to your area or one or one or more of the items was listed at an incorrect price which may be due to human error. In the event of us making a cancellation we will notify you as soon as possible and make sure to re - credit any deducted sum back to you credit card. We will not be obliged to offer any additional compensation for disappointment or inconvenience suffered.
There are temporary cookies called Session cookies which are only present for the duration of your time on our website so we can keep track of things such as keeping your items in the basket for a period of time or keeping track of when you are logged in our out. There are also cookies that are present for much longer which are called Persistent cookies. These cookies are mainly used for analytical purposes so that we are able to keep track of how our customers are using our website. This helps us improve the service that we give to you.
When you use our website you agree to us using cookies in this way. If you are not happy with this , you are able to disable cookies in your browser, but by doing this you may cause the website to not be able to function properly.
We reserve the right to edit and/or not publish your review submissions. This is to avoid unsavory language appearing on our website.
We have tried our very best to display all product descriptions as accurately as possible. Make sure to check all the measurements of each products to ensure that you are aware of the true size of the product you will be receiving. All products are sold as one piece unless stated otherwise and the price displayed is for one unit, (unless otherwise stated in the product name that the product is a set and contains multiple pieces).
Limitation of Liability
If you receive an order which is damaged or defective or the incorrect quantity is delivered, we will have no liability to you unless you notify us by email or telephone explaining the problem within 7 working days of the delivery of the goods in question.
If you do not receive the goods ordered within 7 working days of the date on which you ordered them, we shall have no liability to you unless you notify us by email of the problem within 30 days of the date on which you ordered the goods. If you notify us of a problem under this condition, our only obligation will be, at your option either
·To make good any shortage or non-delivery
·To replace any goods that are damaged or defective
·To refund the amount paid by you for the goods in question
We will not be held liable to you for any indirect or consequential loss, damage or expenses arising out of any problem you notify us of under this condition and will have no liability to pay you any money by way of compensation. Further, we cannot be held responsible for any delays once the goods have left us and are in possession of the delivery carrier or post office.
All transactions are deemed to be completed within the United Kingdom and as such are governed and interpreted by English Law.
It is possible for us to change our terms and conditions at any point.
